How a civil litigation matter proceeds
Each matter is assessed on its own facts and merits. We give realistic advice on the prospects of a claim and on whether negotiation, mediation or contested proceedings suit the situation best.
Before proceedings are issued, we recommend taking legal advice on the merits and risks, considering negotiation or mediation, and sending a formal letter of demand. Litigation involves cost, time and uncertainty, so it is worth weighing up a negotiated or mediated route first where that fits.
Our litigation work runs from advice before a claim is filed through trial, appeal and enforcement. Matters are handled directly by Masha Sylverster as principal lawyer.
To begin, you can call, WhatsApp, email, or send an enquiry through the Contact page; enquiries are reviewed directly by a lawyer.

Frequently Asked Questions
Which courts hear civil disputes in Malaysia?
The Magistrates' Court hears claims up to RM100,000, the Sessions Court up to RM1 million, and the High Court has unlimited jurisdiction. A further appeal lies to the Court of Appeal, and then to the Federal Court if leave is granted.
What is a Mareva injunction?
It is a freezing order that restrains a defendant from disposing of or dissipating assets, before or during a case. The applicant needs to show a good arguable case, together with a real risk of the defendant dissipating assets. In suitable cases the court can hear an urgent application without the other side being told first.
What should I do before starting a civil claim?
Take legal advice on the merits and risks of the claim, look at negotiation or mediation, and send a formal letter of demand before proceedings are issued. A negotiated or mediated route is worth weighing up first where it fits.
Do you act for individuals as well as companies?
The firm acts for individuals and for businesses, and its commercial work covers companies, directors and individuals.
Does the firm handle appeals and enforcement?
Our litigation work extends to appeal and enforcement. Appeals from the subordinate courts and the High Court, and enforcement of money judgments, are among the matters we list.
