How a divorce matter is handled
You can start by phone, WhatsApp, email or the enquiry form on our Contact page. Enquiries sent through the form are treated confidentially and reviewed directly by a lawyer, and we aim to respond within one business day.
From there, our role is to give calm, objective advice and to guide you through each stage of the legal process. Our family practice handles both contested and uncontested matters.
Where it is possible, we work towards resolving the dispute through negotiation, mediation and settlement discussions. We also remain prepared to litigate when that is needed to protect a client's interests.

Frequently Asked Questions
What is the difference between a contested and an uncontested divorce?
In an uncontested divorce, both spouses agree to the divorce and to related matters such as custody and the division of assets, and they file a joint petition. A contested divorce is filed by one spouse where the grounds or the terms are disputed.
How is child custody decided?
The Guardianship of Infants Act 1961 applies, and the child's welfare and best interests come first. The court looks at factors such as the child's age, the bond with each parent, how stable the home is and, where appropriate, the child's own wishes.
Can matrimonial assets be protected while a divorce is under way?
An interim injunction can be sought under the Law Reform (Marriage and Divorce) Act 1976 to stop a spouse dissipating, transferring or disposing of matrimonial assets during the proceedings. The court needs evidence that there is a genuine risk of the assets being disposed of.
Do both spouses have to go to court?
For a joint petition, both spouses would typically attend at least one hearing. In a contested divorce, the spouses or their legal representatives attend hearings as required, and the number of attendances depends on how complex the matter is.
Do you handle settlement negotiations as well as court proceedings?
We advise and act in negotiations, mediation and settlement discussions, and we are also prepared to act in litigation where it is needed.
